Welcome to Charter, operated by Charter Marketplace LTD, a Jersey-registered company.
These Terms of Service ("Terms") govern your access to and use of the Charter platform, website, mobile applications, and related services ("Charter", "we", "our", or "the Platform").
By creating an account or using Charter, you agree to be bound by these Terms.
"Charter" – The aviation marketplace platform operated by Charter Marketplace LTD.
"Client" – Any passenger, agent, or broker submitting flight requests or receiving quotes through Charter.
"Operator" – Any air operator certificate holder or aircraft provider submitting quotes or fulfilling bookings.
"Services" – Marketplace functions including quote requests, quote submissions, messaging, booking confirmations, payments, and related tools.
"Circumvention" – Completing, attempting to complete, or facilitating an aircraft booking outside of Charter after an introduction, quote, or communication has originated on the platform.
Charter acts as a digital intermediary that connects Clients with aviation Operators.
We facilitate communication, the exchange of quotes, booking confirmations, and payment processing.
Charter does not operate aircraft or provide air transportation services.
To use the Platform, you must:
You are responsible for all activity conducted under your account.
All communication between Clients and Operators must occur exclusively through Charter Chat, including:
No party may use external channels such as phone, WhatsApp, personal email, SMS, or social media unless explicitly permitted by Charter.
Clients and Agents must not provide personal contact information directly to Operators.
Operators must not request, solicit, or accept any off-platform contact details from Clients or Agents.
If a booking is confirmed and Charter releases limited operational contact information automatically, communication is allowed solely for operational purposes (e.g. passenger manifests, handling arrangements).
All commercial discussions must remain on-platform.

If Charter determines that circumvention or off-platform communication has occurred:
Charter reserves the right to deny future access to any individual or organisation involved in bypassing the platform.
Charter facilitates quote requests, quote submissions, availability checks, and booking confirmations.
A booking is confirmed only when Charter issues a formal confirmation via the Platform.
Operators are solely responsible for:
Charter does not control or operate the flights.
Charter Marketplace LTD acts as the Merchant of Record.
Clients submit payment to Charter, and Charter remits funds to the Operator, less applicable commission.
Charter applies a commission fee as published within the Platform from time to time.
Commission may vary based on market, region, aircraft type, or promotional structure.
Refunds, cancellations, and payment schedules are determined by the Operator's policies, which apply to each booking and are displayed in the quote or booking confirmation.
Charter facilitates refunds but is not responsible for Operator-set terms.
Charter must comply with applicable sanctions, embargo, anti-money laundering, and counter-terrorist financing laws and the policies of our banking partners. For this purpose, we may screen (or require screening of) flights, users, counterparties, and payments by reference to recognised sanctions regimes, including the United States Office of Foreign Assets Control (OFAC), the United Kingdom HM Treasury / Office of Financial Sanctions Implementation (OFSI), and United Nations Security Council sanctions (as updated from time to time).
Charter may refuse service, suspend accounts, cancel quotes or bookings, or place a transaction on hold if we reasonably believe that a booking, flight, user, passenger, operator, beneficial owner, payment, or routing may breach sanctions or create regulatory, banking, or compliance risk. This includes (without limitation) flights departing from, arriving in, stopping in, or otherwise involving restricted jurisdictions.
You warrant that you are not a sanctioned or restricted person, that you are not located in a sanctioned or restricted jurisdiction, and that you will not use Charter to facilitate any prohibited transaction.
Payments are conditional upon sanctions and compliance clearance. Funds may be delayed, rejected, returned, frozen, or withheld by banks or other third parties, and Charter does not guarantee any timelines where such checks apply.
Charter may request additional information to complete compliance checks, and our determinations under this clause are final for the purposes of Platform access and transaction processing.
If a booking originating through Charter is completed off-platform, Charter may:

To the fullest extent permitted by law:
Nothing in these Terms excludes liability where exclusion is prohibited by law.
Charter may suspend or terminate access immediately if:
Suspension decisions may be permanent.
Use of Charter is also governed by our Privacy Policy, which explains how data is collected and used.
Charter may modify these Terms at any time.
Continued use of the Platform after changes constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Bailiwick of Jersey.
Any dispute arising from these Terms or use of the Platform will be resolved exclusively through the Jersey courts.
